The journalist who accuses Trump of rape in the 90s relaunches her complaint in New York

After the appointment of a special prosecutor to investigate Trump, then the rehabilitation of his Twitter account, we never stop hearing about the former American president. This Thursday an American journalist, E. Jean Carroll, who accuses Donald Trump of raping her in the 1990s, relaunched her civil case against him, thanks to a new New York law that protects victims of sexual assaults.

A dual court case alleging rape and defamation has pitted Ms. Carroll, 78, against Mr. Trump, 76, in federal civil court in Manhattan since 2019, both of whom produced their sworn statements in October before a New Yorker judge .

Libel suit

In the libel proceedings, E. Jean Carroll, author and former magazine columnist Sheshe had attacked Donald Trump in a civil court case in November 2019. She accused him of defaming her for calling a “complete lie” in June 2019 of her allegations of rape in a dressing room of a New Yorkers department store in 1995 or 1996.

The then-incumbent Republican president (2017-2021) replied that he had never met her and that she “wasn’t his type of woman.” His lawyers have also always said that he was protected in 2019 by his immunity as head of state.

Regarding the rape allegations, Ms Carroll was unable to file a formal complaint in 2019 as the alleged facts were time-barred.

Several documents accusing Trump of “rape” made public

However, on November 24, a new law went into effect in the State of New York (“Adult Survivors Act”) which allows victims of sexual assault to reactivate any old complaints and to file a civil lawsuit for one year.

Ms. Carroll’s law firm, Kaplan Hecker and Fink, and Manhattan’s federal court system then released multiple court documents Thursday accusing Trump of “rape” and seeking a civil trial in 2023 to obtain damages and interest.

In the preamble to the complaint, which is now admissible and which states all the facts, Donald Trump is accused “about 27 years ago (…) at the Bergdorf Goodman luxury department store on Fifth Avenue in New York (from ) of kidnapping E. Jean Carroll, pinning and pinning her against a dressing room wall with his shoulder and raping her.”

“Hoax and Lie”

The complainant had been silent for more than 20 years before telling her story in a book in the late 2010s in favor of the #MeToo movement launched in 2017 against violence against women.

“If I respect and admire people who speak up, this case unfortunately constitutes a deviation from the objective of the law which creates a serious precedent and risks delegitimizing the words of the real victims,” ​​Trump’s lawyer Alina Habba reacted to AFP on Thursday in case.

Last October, the former president called the allegations a “hoax and a lie”. And this new rant of the businessman on October 12 on his Truth Social network, making fun of this alleged rape, also allows Ms. Carroll to revive the defamatory component of her legal action against Mr. Trump, this time taken targeted as a private citizen without presidential immunity.
